ISF Enforcement Update

As a reminder, effective July 1, 2016, U.S. Customs & Border Protection (CBP) will no longer be required to send requests for liquidated damages (LD) claims to their headquarters for review before issuing liquidated damages to those importers not in compliance of the Importer’s Security Filing. Additionally, CBP announced that the former three-strikes and you’re out approach has ended. There is no change to cargo holds for ISF non-compliance; ports may continue to hold cargo instead of, or in addition to initiating LD claims.
